The petitioner apprehends his arrest in Complaint Case No.421 of 2016 for the offences punishable under Sections 420, 467, 468 and 120B of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the petitioner is a Bank Manager and only allegation against him is that instead of KCC loan he has granted tractor loan. However, tractor has already been handed over to the loanee and in similar circumstances other accused persons have been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 5.12.2016 passed in Cr.Misc.No.33806 of 2016.

Having heard both sides. In view of the facts, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Samastipur in connection with Complaint Case No.421 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and subject to the further conditions that:

(i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.

(ii) The petitioner shall cooperate in the investigation and make himself available as and when required by the police and on the event of failure on his part to appear before the police on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail bonds.
