The sole petitioner, who is in custody since 02.07.2016 in Baisi P.S. Case No.100 of 2016 registered for the offence under Section 273 of the Indian Penal Code and Section 47(a) of the Bihar Excise (Amendment) Act, 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. He further submits that in similar circumstances, two other accused persons have already been granted bail, whereas Sri Nirmal Kumar Sinha, learned Addl. Public Prosecutor , opposing

Patna High Court Cr.Misc. No.41006 of 2016 (2) dt.03-10-2016 2/2 the prayer for bail, submits that huge quantity of Indian Make Liquor to the tune of 78 liters were recovered from a vehicle, on which the petitioner was also travelling.

Be that as it may, keeping in view the nature of accusation, let the petitioner, namely, Raj Kumar Yadav @ Rinku be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Baisi P.S. Case No.100/2016.
