JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 05-10-2016 Heard learned counsel for the petitioner, learned counsel for the informant as well as learned APP. It has been alleged by the informant that on 03.01.2016 at about 10:00 A.M, petitioner Sanjay Yadav accompanied his son, Uday Yadav in order to facilitate purchase of a Bullet Motorcycle and for that purpose Rs. 1 Lac was taken from house while remaining amount was to be obtained from his Sasural. On the same day at about 8:00 P.M.

Patna High Court Cr.Misc. No.43647 of 2016 (2) dt.05-10-2016 indulged in pushing and pulling. As soon as they saw the informant and others, Ram Bilas Yadav who was armed with country made pistol fired striking over chest of his son as a result of which he died. It has also been disclosed that motorcycle of petitioner was lying there.

The prayer of the petitioner for bail has been resisted by the learned counsel for the informant submitting that petitioner is the person who took away the deceased on the same day at about 10:00 a.m. and so his complicity during commission of the crime was very much exposed.

Considering the specific allegation having been attributed to Ram Bilas Yadav to be assailant of the deceased, petitioner, Sanjay Yadav, is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of ADJ-3rd, Purnea in connection with S.T. No.139/2016 arising out of K. Nagar PS Case No. 02/2016 corresponding to G.R. No. 46/2016.
