Learned Sr. Counsel appearing on behalf of the Indian Oil Corporation submits that the application has now become infructuous as the advertisement has taken its own course and 3rd party rights have been created. Moreover, the application is also bad for non-joinder for necessary parties. As such, the application may be dismissed.

However, it appears that there is no one to press the present application.
