====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-12-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Sour Bazar (Baijnathpur O.P.) P.S. Case No.614 of 2017 registered under Section 392 of the Indian Penal Code.

Regarding the snatching of a bag containing Rs.1,11,335/- and a mobile set, kept in the said bag, of the informant, the present case was lodged against unknown. Learned counsel appearing on behalf of the petitioner submits that, in course of investigation, one Bharat Kumar was apprehended by the police and his confessional statement was recorded in which he disclosed the name of the petitioner as his associate. Except that, no material has been collected by the

Patna High Court Cr.Misc. No.71280 of 2018(2) dt.04-12-2018 2/2 police in course of investigation against the petitioner. Further submission is that, in fact, the petitioner is accused in four other cases, as detailed in paragraph-3 to this application, in which he is on bail, due to that reason, the police has implicated the petitioner in the present case. The petitioner is in custody since 25.05.2018. After investigation, the charge-sheet has already been submitted by the police.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Sour Bazar (Baijnathpur O.P.) P.S. Case No.614 of 2017. Out of the two sureties, one must be either parents or the close relative of the petitioner.
