JUSTICE SATYAVRAT VERMA ORAL ORDER 06-05-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in a case registered for the offences punishable under Section 30(A) of the Excise Act, 2018.

The learned counsel for the petitioner submits that the petitioner is in custody since 18.11.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 436 litre of liquor from the house of the petitioner.

The learned counsel for the petitioner submits that the house is a joint family property and as such, the petitioner was

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case Excise No.7498 of 2021 arising out of Bihta P. S. Case No.879 of 2021. The application stands allowed.
