The petitioners apprehend their arrest in a case under Section 307 and other sections of the Indian Penal Code. The police lodged the case naming different persons including the petitioners but the informant did not make any specific allegation of assault against the petitioners. It is alleged that petitioners, who happen to be father and two sons, were leading the mob.
It is submitted that there is counter version. One land was settled in favour of Lalu Rai and the police in collusion with ex-landlord tried to vacate the land and demolished the house of Lalu Rai with JCB machine and assaulted his pregnant daughter-

Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st class, Gopalganj in Baikunthpur P.S. Case No. 102 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
