JUSTICE RAKESH KUMAR ORAL ORDER 27-10-2016 Heard Sri Jagdish Prasad, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 23.02.2016 with clean antecedent, as stated in paragraph-3 of the petition, has prayed for grant of bail in Pipra P.S. Case No.29/16 registered for the offence under Sections 379, 411 of the Indian Penal Code and Section 7 of the Essential Commodities Act. It was submitted by learned counsel for the petitioner that the petitioner was driver of tanker and it was alleged that from the tanker diesel/petrol was being stolen. The petitioner and others were arrested.
Learned Addl. Public Prosecutor, opposing the prayer for bail of the petitioner, submits that from possession of
Patna High Court Cr.Misc. No.46323 of 2016 (2) dt.27-10-2016 2/2 the petitioner Rs.60,500/- was recovered, which was said to be money of sold diesel/petrol illegally.
It was submitted by learned counsel for the petitioner that save and except submission of chargesheet, till date no adequate progress has taken in the case.
Keeping in view the nature of accusation, period of custody as well as clean antecedent of the petitioner, let the petitioner, namely, Sunil Das be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sadar Motihari in connection with Pipra P.S. Case No.29/16.
