Petitioners apprehend their arrest in connection with Trial No. 2200 of 2014 arising out of Complaint Case No. 2550 of 2013 registered under Sections-406, 498A, 102B of the Indian Penal Code and Section-4 of Dowry Prohibition Act. The complainant claims that petitioners are her parents-inlaw but it is submitted on behalf of the petitioners that earlier the complainant filed Complaint Case No. 450 of 2002 against one Lakhindra Sahani and as a matter of fact, the said Lakhendra Sahani is the husband of the complainant and petitioners are not in-laws of the complainant. It is further pointed out by him that earlier the complainant lodged Complaint Case No. 1205 of 2006
Patna High Court Cr.Misc. No.51878 of 2014 (2) dt.05-01-2015 2/2 against the petitioners but the aforesaid complaint case was dismissed and the petitioners were discharged from the above-said case.
Taking into consideration the above-said facts and circumstances as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest or surrender in the court below within four weeks from today, the petitioners named-above, are directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Trial No. 2200 of 2014 arising out of Complaint Case No. 2550 of 2013 to the satisfaction of Sub Divisional Judicial Magistrate (East), Muzaffarpur subject to conditions as laid down u/S 438(2) of the Cr. P.C.
