This application for anticipatory bail arises out of Biraul P.S. Case No. 241 of 2013, disclosing offences under Section 379 of the Indian Penal Code.

The petitioner has approached this Court five years after registration of the first information report. There is no material for this Court to understand as to what makes the petitioner apprehend his arrest.

I am not inclined to entertain this application for anticipatory bail, filed five years after registration of the first information report.

This application is rejected.

The petitioner is directed to surrender before the court

Patna High Court Cr.Misc. No.73192 of 2018(2) dt.20-12-2018 2/2 below within four weeks from today and seeks regular bail, if so advised. If they do so, their application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail by this Court.
