2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise (Amendment) Act.
3. It is alleged that 20 liters of country made alcohol was recovered from the place of occurrence and 1400 kg of raw wine has been destroyed.
4. It is submitted that the petitioner is innocent and has falsely been implicated in this case . From bare perusal of the seizure list, it is apparent that no incriminating material has been recovered from the conscious possession of the petitioner and neither he has been apprehended on the spot. Petitioner is

5. Learned counsel for the State opposes the bail petition.
6. Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge , Excise Court No. 2 , Motihari, East Champaran in connection with Excise Police Station Case No. 386 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
