JUSTICE RAKESH KUMAR ORAL ORDER 06-10-2016 Heard Sri Ajit Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 25.06.2016 in Barhara P.S. Case No.134 of 2016 registered for the offence under Sections 272 and 273 of the Indian Penal Code and Section 47 of the Bihar Excise Amendment Act, 2016, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that on allegation of recovery of about 12 liters of country made liquor, the petitioner has been made accused. It was also alleged that some quantity of unprepared liquor was recovered, which was destroyed. By way of referring to the statement made in paragraph-3 of the petition, learned counsel for
Patna High Court Cr.Misc. No.42938 of 2016 (2) dt.06-10-2016 2/2 the petitioner submits that the petitioner is having clean antecedent.
Keeping in view the nature of accusation, period of custody and clean antecedent of the petitioner, let the petitioner, namely, Ram Babu Murmu @ Babu Ram Murmu be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Barhara P.S. Case No.134/2016.
