1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 353, 379, 411 and 34 of the Indian Penal Code and under Sections 56(i) and 56(ii) of the BMMC Rule, 2019.
3. Learned counsel for the petitioners submits that the petitioner no. 1 has antecedent of six cases and petitioner no. 2 has antecedent of one case and the informant alleges that on information of illegal sand mining, he went to raid the
Patna High Court CR. MISC. No.24796 of 2023(2) dt.19-07-2023 2/3 place of occurrence where the accused persons created ruckus and assaulted them, further a tractor was seized.

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case, it is next submitted that the seized tractor does not belong to the petitioners nor the petitioners have any concern with illegal sand mining, but since the petitioner no. 1 was implicated earlier in one case on account of which he came to be implicated in five other cases, it is next submitted that in one case, the police has submitted Final Form and in rest of the cases he is on bail. It is also submitted that though there is allegation of assault but then the allegation is not specific.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with
