JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is languishing in jail custody since 26-072016 in a case registered under Section-376 & other minor sections of the Indian Penal Code.

There is case and counter case between the parties and both the parties are levelling allegation against each others. The informant of the present case claims that the petitioner having entered into her house, made attempt to commit rape on her but she anyhow eluded herself from clutches of the petitioner and gave one stab blow, which caused injury on the private part of the petitioner whereas; the petitioner claims that on the alleged date of occurrence, the present informant as well as her family members

Patna High Court Cr.Misc. No.40847 of 2016 (3) dt.24-11-2016 2/2 caught him and husband of the informant caused injury on his private part.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Gopalganj (Mahila) P.S. Case No. 66 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Gopalganj.
