JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Barahara (Krishnagarh) P.S. Case No. 353 of 2016 registered under Section 30 of Bihar Prohibition & Excise Amendment Act, 2016.

The accusation is that on receiving secrete information, police raided the brick-kiln of Bheem Singh, the father of the petitioner and from the east side of brick kiln apprehended 4 persons along with three motorcycle with total 290 litres of foreign liquor and they disclosed their names as Rohit Kumar Singh, Gunjesh Kumar Singh, Rakesh Kumar and Mohit Kumar and they further disclosed that seized wine is of the petitioner.

No.5072 of 2017 (2) dt.17-03-2017 The learned counsel for the petitioner has submitted that the said foreign liquor is not recovered from the possession of the petitioner or from the brick-kiln rather the same has been recovered nearby the brick-kiln in the field. Co-accused persons have taken the name of the petitioner with an ulterior motive. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur, Ara in connection with Barahara (Krishnagarh) P.S. Case No. 353 of 2016 subject to the conditions laid down under Section 438(2) Cr.P.C.
