Petitioners seek bail in Jaynagar P.S. Case No. 454 of 2018 instituted for the offence under Section(s) 302, 201/34 Indian Penal Code.

In the written report it is alleged that daughter of informant namely, Punam Devi was married with Raushan Mehra (petitioner No. 2). Petitioner No. 2 has performed another marriage with Binita Devi to which the informant has raised protest. The informant got information on 10.8.2018 that dead body of female child was lying in the sugarcane crop of Shivshankar Yadav. The informant went there and found dead body of her grand-daughter Soni Kumari aged about one year

Patna High Court Cr.Misc. No.73994 of 2018(2) dt.11-12-2018 2/2 who is daughter of petitioner No 2. There was injury on her neck. She has raised suspicion against this petitioner, her own daughter and son-in-law.

Counsel for the petitioner submits that mere suspicion has been raised by the informant against petitioner No. 2 because he has performed another marriage. Binita Devi is living with petitioner No. 2.

Petitioners are in custody since 16.8.2018.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Madhubani, in connection with Jaynagar P.S. Case No. 454 of 2018, subject to the condition that both the bailors shall be close relative of the petitioners. (Sanjay Priya, J) S.Ali/- U T
