====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 26-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Dehri P.S. Case No. 55 of 2021 lodged under Sections 399, 402, 414 of the Indian Penal Code read with Section 25(1-b)a, 26/35 of the Arms Act.

Learned counsel for the petitioner submits that the present case has been lodged against 5 known persons including petitioner.

Learned counsel for the petitioner further submits that though his name has figured in the F.I.R. but his name has been disclosed by the co-accused who were caught by the police, and he has not caught from the place of occurrence. Learned counsel for the petitioner further submits that

No.22746 of 2022(2) dt.26-07-2022 2/3 the named accused namely Rahul Kumar, Danish Khan and Lal Krishna Gupta are granted bail by the Co-ordinate Bench of this Court vide order dated 01.04.2022 passed in Cr. Misc. No. 53810 of 2021, vide order dated 16.02.2022 passed in Cr. Misc. No. 5307 of 2022 and vide order dated 26.04.2022 passed in Cr. Misc. No. 66624 of 2021.

Learned counsel for the petitioner further submits that petitioner is a student and he is in custody since 23.01.2022 and charge sheet has already been filed in this case and he has clean antecedent.

Learned counsel for the State opposes the prayer for bail.

Considering the facts and circumstances and the submissions made above of this case, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Dehri Rohtas Sasaram in connection with Dehri P.S. Case No. 55 of 2021, subject to the conditions as laid down under Section 437(3) of the Cr.P.C.

The petitioner is directed to appear on each and every date before the Trial Court, in case of non-appearance for two

Patna High Court CR. MISC. No.22746 of 2022(2) dt.26-07-2022 3/3 consecutive dates, shall resulted into cancellation of his bail bond. If he shall involve in such type of activities again, the prosecution shall be at liberty to move for cancellation of his bail bond.
