Petitioners apprehend their arrest in a case registered for the offence punishable under Section 323, 324 and some other allied Sections of the Indian Penal Code. As per the prosecution case, on 21.08.2020 at about 9 AM, seven named and two unknown persons, including the petitioners, armed with Lathi, Farsa, Khanit and Dabiya came to the informant's house with a view to grab her homestead land. On protest, petitioner No.1 is alleged to have assaulted the informant with Farsa on her head. Petitioner No.2 is alleged to have assaulted the son of informant with Dabiya on his head.

Patna High Court CR. MISC. No.33915 of 2021(3) dt.23-06-2022 2/2 Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. It is submitted that there is land dispute between the parties. There is case and counter case and injury has been reported to be simple in nature. Petitioners have got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the backdrop of the case, nature of injuries and clean antecedent of the petitioners, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI, Araria in connection with Raniganj PS case No. 425/2020, subject to conditions laid down u/s 438(2) of the Cr. P. C.
