JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 24-11-2022 This matter has been mentioned for urgent hearing, however, in course of oral mentioning, learned counsel for the petitioner has informed this Court that the writ application has been filed seeking a direction to the investigating agency to conduct further investigation in Beur P.S. Case No. 298 of 2020 dated 07.11.2020 registered under Sections 420/34 of the Indian Penal Code and 25(1-b)a/26/35 Arms Act and Section 3/4/11 of Bihar Bengal Gambling Act.

Learned counsel for the petitioner agrees with the view of this Court that the petitioner has a remedy available

Patna High Court CR. WJC No.480 of 2022(2) dt.24-11-2022 2/2 under Section 173(8) Cr.P.C. to apply for further investigation before the learned jurisdictional Magistrate. Learned counsel, therefore, prays to withdraw this application with liberty to the petitioner to apply for his remedy in the learned court below as well as the competent authority of the investigating agency as the case may be.

Permission is granted.

The application is allowed to be withdrawn with liberty as prayed for.
