The petitioner apprehends her arrest in Kotwali (Barari) P.S. case No. 517 of 2016 under Section 419, 420 of the Indian Penal Code.
The informant alleged that she is working as class-IV employee in Health Centre, Tarar, Bhagalpur. Her friend, Mira Mishra, the petitioner, cheated her and took her bank pass book and cheque book. She further alleged that petitioner, in collusion with the bank employees, illegally withdrew Rs. 10 lacs from her account. The informant got message on 25.07.2016 that Rs. 4700/- was withdrawn from her account. The informant enquired and came to know that Mira Mishra withdrew the amount from her account and she returned Rs. 4500/.
Patna High Court Cr.Misc. No.3696 of 2017 (11) dt.22-05-2017 2/2 The learned counsel for the petitioner submits that entire statement of the account of the informant has been taken and only Rs. 1, 19,000/- was withdrawn on different dates. It has come that Rs. 10 lacs was not withdrawn from the account of the informant. The Branch Manager of the bank stated that it was the informant, who was withdrawing the money from her account, and she made false allegation that her cheque book was lost.
Considering the facts that petitioner is a lady and there is no allegation that petitioner forged signature of the informant, the above named petitioner, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in Kotwali (Barari) P.S. Case No. 517 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
