The petitioner is apprehending his arrest in connection with Saharsa (Sadar) P.S.Case No.609 of 2018 dated 20.5.2018 , registered for offences punishable under Section 392 of the Indian Penal Code and Section 27 of the Arms Act. Prosecution story is of snatching of motorcycle of informant by two miscreants. The petitioner is not named in the FIR and it appears that later on one co-accused was arrested and on his confessional statement, name of the petitioner has transpired.

Submission of the learned counsel for the petitioner is that except confession, there is nothing against the petitioner, no recovery and he has no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saharsa in connection with Saharsa (Sadar ) P.S.Case No.609 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with condition to co-operate in the investigation, otherwise the prosecution is at liberty to move for cancellation of his bail bond.

With the aforesaid direction, this application is allowed.
