JUSTICE SUDHIR SINGH ORAL ORDER 23-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 394 of the Indian Penal Code.
Prosecution case is that informant along with two other persons were proceeding towards Gaya in a truck carrying turmeric. In course of journey, two persons in a scorpio came before their truck, took the key of the truck, looted their belongings and proceeded towards Gaya with the truck. It has been submitted on behalf of the petitioner that he is in custody since 28.3.2016. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. He is not named in the F.I.R. His name has come on the basis of confessional statement of the coaccused. He has not been put on T.I.P. There is no recovery of any incriminating article from the possession of the petitioner. On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the
Patna High Court Cr.Misc. No.26384 of 2016 (3) dt.23-08-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar at Aurangabad, in connection with Haspura P.S. Case no. 7 of 2016.
