====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 11-07-2023 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 363, 366(A) and 34 of the Indian Penal Code.

The informant alleges that on 27.06.2022 at about 07.00 PM his minor daughter aged about 15 years had gone to the shop but did not return, it is next alleged that on search he came to know that the accused persons including the petitioners had kidnapped his daughter for the purposes of marriage. Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and petitioner nos. 2 and 3 are women and have been falsely implicated in the

No. 22353 of 2023(2) dt.11-07-2023 2/2 present case, it is next submitted that the victim has come back and her statement was recorded under Section 164 Cr.P.C. wherein she has not supported the case of the prosecution, further she has stated that she had gone to the house of her maternal aunt, it is further submitted that date of occurrence is 27.06.2022 and the FIR came to be instituted on 12.07.2022 i.e., after a delay of more than fifteen days.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bathnaha P.S. Case No. 182 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
