JUSTICE SUDHIR SINGH ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 384 and 386 of the Indian Penal Code. Allegation against petitioner is of demanding extortion money of Rs. 5 lacs from informant.

It has been submitted on behalf of petitioner that he is in custody since 25.8.2012. Chargesheet has been submitted against petitioner. He has remained in custody for more than four years in the present case. He is not named in the F.I.R. though there is no substantive evidence to suggest his implication in the present case. On behalf of the State, it is submitted that there are as many as 25 cases pending against petitioner. The said cases relate to the year 2009-12 and there is no recent case instituted against petitioner.

Considering the aforesaid facts and circumstances and period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only)

Patna High Court Cr.Misc. No.44355 of 2016 (3) dt.05-12-2016 2/2 with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Raxaul at Motihari, East Champaran, in connection with Trial no. 175 of 2015 arising out of Chhauradano P.S. Case no. 26 of 2012.
