JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-02-2017 The petitioner is apprehending his arrest in connection with Guraru P.S. Case No. 69 of 2012, registered for offences punishable under Section 395 of the Indian Penal Code. It has been submitted on behalf of the petitioner that petitioner's name has transpired in this case during the course of investigation on the basis of confessional statement of co-accused and the petitioner has also filed a petitioner before the court below that he is not known to the said co-accused, which has made the statement against the petitioner. It has further been submitted that the petitioner has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides, in view of the fact that the case is under Section 395 of the Indian Penal Code and the

Patna High Court Cr.Misc. No.7495 of 2017 (2) dt.23-02-2017 2/2 investigation is still going on, as such, I am not inclined to grant the petitioner, the privilege of anticipatory bail, at this stage, it is accordingly rejected.

Petitioners are directed to surrender before the court below and pray for regular bail and if any such application is filed, the court below shall consider the same and pass an appropriate order without being prejudiced by the order of this Court. With the above observation, this application is disposed of .
