JUSTICE BIRENDRA KUMAR ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody in connection with Bhabua P.S. Case No. 351 of 2016 for the offences punishable under Section 188/34 of the Indian Penal Code and Section 20B(i) of the Narcotic Drugs and Psychotropic Substances Act.
The authorities committed raid in the premise of Bhabua Jail. From the possession of this petitioner Rs.3400/-, two packets of cigarette and two knives were recovered. Ganza was recovered from some other co-accused.
Submission of the petitioner is that none of the jail employee is accused in this case and it was desirable in such
Patna High Court Cr.Misc. No.53829 of 2016 (2) dt.13-01-2017 2/2 type of case that conduct of the jail employee should also be looked into, in allowing entrance of such material in the jail premises. Petitioner is in custody since 08.09.2016. Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI, Kaimur (Bhabua)/Successor Court, in connection with Bhabua P.S. Case No.351 of 2016.
Let a copy of this order be sent to the Director General of Police, Bihar, for needful.
