2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Ramgarh P.S. Case No. 432 of 2024, lodged on 05.12.2024, under Sections 126(2)/115(2)/352/351(2)/79/ 74 /303(2)/109(1)/3(5) of the Bhartiya Nyay Sanhita, 2023.
3. As per the prosecution, FIR has been lodged against seven named accused persons including the present petitioner. Specific allegation against the petitioner is that he has assaulted by iron rod on the informant's husband due to which the husband of the informant became unconscious and thereafter
Patna High Court CR. MISC. No.20992 of 2025(2) dt.23-04-2025 2/3 allegation of snatching of gold chian and Mangalsutra has been made.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that antecedent of the petitioner is clean. Counsel further submits that for the same date and place of occurrence Ramgarh P.S. Case No.432 of 2024 has been filed by the informant side and another Ramgarh P.S. Case No.433 of 2024 has been filed from the petitioner's side. Learned Counsel further submits that from the FIR itself it becomes clear that for taking possession on the land scuffle has taken place. He submits that scuffling took place from both the sides and description of land has been mentioned in the FIR of the petitioner. Counsel submits that petitioner's were in possession and they were doing the cultivation work. It is the informant's version who used to visit and wants to dispossess due to which the entire occurrence has arisen.
5. Learned Counsel for the Informant, on the other hand, submits that allegation of assault is clear cut and the injury report indicates that the allegation made in the FIR is correct.
6. Learned APP for the State opposes the prayer for
Patna High Court CR. MISC. No.20992 of 2025(2) dt.23-04-2025 3/3 bail of the petitioner.
7. In the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of Additional Chief Judicial Magistrate-I, Kaimur at Bhabua, in connection with Ramgarh P.S. Case No. 432 of 2024, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023. (Dr. Anshuman, J) Mkr./- U
