This is a petition for grant of regular bail for offence under Sections 363 and 366 of the Indian Penal Code. The first information report was lodged on missing of Sinu Kumari, aged about 18 years. The petitioner is under suspicion to have kidnapped her. The victim girl, in her statement before the police, stated that she has love affairs with the petitioner and she had voluntarily gone with the petitioner. However, later on, in her statement under Section 164 of the Criminal Procedure Code, she alleged that the petitioner induced her to go with him and established physical relation. Submission of the petitioner is that the marriage certificate annexed with the supplementary affidavit would reveal that initially the victim had married with the petitioner in a temple and subsequently, under pressure of her parents, she had already married with some other boy.

Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.44670 of 2016 (5) dt.30-01-2017 2/2 Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Giriak P.S. Case No. 191 of 2016 to the satisfaction of Sri Sushil Prasad, Judicial Magistrate, 1st Class, Nalanda at Biharsharif, or successor Court.
