JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2019 This is an application for grant of anticipatory bail in connection with Khanpur P.S. Case No. 148 of 2018, disclosing offences under Sections 406, 409 & 420 of the Indian Penal Code.

Petitioner was the Manager of Rebra PACS and there is allegation of defalcation of Rs.41,13,630/- of the depositors and the PACS.

Submission of the learned counsel for the petitioner is from drawing my attention to Annexure 2 has submitted that petitioner has been terminated from the Manager seat in the year 2015 itself whereas the occurrence relates to the year 2017-18 and as such, whole allegation are false and concocted. It has further been submitted that as a matter of fact, after the date of being Chairman of the PACS, another Chairman in collusion

Patna High Court CR. MISC. No.20989 of 2019(3) dt.20-06-2019 2/2 with the other has filed the present case against the petitioner. Heard learned A.P.P. also.

Having heard both sides, in view of the facts and circumstances, as stated above, let the petitioner surrender before the court below by 05.07.2019 and on his surrender, the Court shall release him on provisional bail on the condition that he will co-operate the Investigating Officer and produce all his supporting documents, who will examine the same. However, despite on that if the charge sheet is submitted against him, he is to surrender and make prayer for regular bail, the same shall be considered by the learned trial court on its own, without being prejudiced by order of this Court.
