1. Heard learned counsel for the parties.

2. The petitioner in this application prays for grant of anticipatory bail apprehending his arrest in connection with Complaint Case no.712 of 2023 registered for the offence punishable under sections 498A, 323, 327, 342 and 504 of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act.

3. As per the prosecution case, the petitioner was married to the opposite party no.2 in the year 2005. It is stated that the accused persons and specially the petitioner herein started to torture the complainant for nonfulfillment of demand

Patna High Court CR. MISC. No.21984 of 2025(4) dt.10-09-2025 2/3 of dowry by way of a Hero Honda motorcycle. She was abused, assaulted and forced out from the house. Hence the instant case.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case only for the reason that he happens to be the husband of the complainant. The petitioner has always been ready to amicably settle the dispute between the parties. He has no criminal antecedent and undertakes to cooperate in the case.

5. The application for bail is opposed by learned APP for the State and learned counsel for the complainant. It is submitted by learned counsel for the complainant that the complainant has always been ready to amicably live with the petitioner, however, she has been abused, tortured and forced out from the house.

6. It transpires from the record of the case that the matter was earlier referred to the Patna High Court Mediation Centre. As per the report received dated 26.5.2025 from the Mediator, the dispute could not be resolved between the parties and the mediation failed.

7. Having heard learned counsel for the parties and taking into consideration the allegations in the complaint and specially the petitioner not having any criminal antecedent, it is

No.21984 of 2025(4) dt.10-09-2025 3/3 directed that the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Complaint Case no.712 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sasaram.
