The petitioner seeks bail in connection with Piro P.S. Case No. 193 of 2018 instituted for the offence under Section(s) 413/414 of the Indian Penal Code.
Learned counsel for petitioner submits that petitioner is not named in the written report. There is no recovery of any incriminating article from possession of this petitioner. It has further been submitted that one of the co accused of this case has already been granted regular bail by this Hon'ble Court vide order dated 12.10.2018 passed in Cr. Misc. no. 62441 of 2018 In the written report, it is alleged that during patrolling duty police, on chase, arrested one Sukhdeo Muni
Patna High Court Cr.Misc. No.72964 of 2018(2) dt.07-12-2018 2/2 with motorcycle, who disclosed that aforesaid motorcycle was stolen motorcycle. He disclosed before the police the name of his companions which include the name of this petitioner. Petitioner is in custody since 7.6.2018 having no criminal antecedent.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1, Ara, Bhojpur in connection with Piro P.S. Case No. 193 of 2018, subject to the condition that both the bailoers shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
