The petitioners apprehend their arrest in connection with Nanpur P.S. Case No. 172 of 2015 registered under Sections 302/201/34 of the Indian Penal Code. The allegation of informant Mira Devi is that on 24.02.2015 at about 10.00 pm. accused Ranjit Kumar and both petitioners were blocking the lane in front of the house of complainant/informant then Umesh Jha, brother-in-law of the informant made protest in which he was assaulted by them. In the meantime, husband of the informant/complainant, Feku Jha came and made protest at which he was also assaulted. In that course, Umesh Jha, brother-in-law of the informant reached and made intervention but Feku Jha, husband of the informant/complainant died, while the informant and her brother-in-law, Umesh Jha started to move for Police Station then the Mukhiya and Sarpanch
Patna High Court Cr.Misc. No.42622 of 2015 (2) dt.08-10-2015 2/2 of the village stopped them saying to compensate the death of Feku Jha and signature of Ranjit Jha and Umesh Kumar Jha was obtained on a paper by Panches and thereafter, the dead body of husband of the informant/complainant was disposed of.. Learned counsel appearing on behalf of the petitioners submits that petitioners and informant are agnates and they are pattidar of the complainant/informant Meera Devi. In fact, Feku Jha, husband of the complainant/informant died in natural death and his dead body was cremated but due to dispute of the way, the informant filed the complaint petition on 09.04.2015 showing the occurrence of murder of her husband on 24.02.2015, on which basis the present case has been instituted.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Pupri, District - Sitamarhi in connection with Nanpur P.S. Case No. 172 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C. Shail/- (Rajendra Kumar Mishra, J.)
