The petitioner apprehends her arrest in connection with Ramgarh P.S. Case No. 04 of 2019 registered under Sections 467, 468, 471, 420 and 120(B) of the Indian Penal Code.
The accusation is that informant being the President of Executive and Management Committee of Ward No. 7 of Mahuwari Panchayat, reached on 03.01.2019 to print her passbook then it was detected that Rs.4,42,500/- was fraudulently withdrawn from her account. On query, she came to know that petitioner along with Pintu Kharwar and Sanjay Mishra, proprietor of Om Sai Traders had arrived at her house
Patna High Court CR. MISC. No.21083 of 2019(3) dt.05-08-2019 2/3 and a cheque of Rs.12,000/- was given in favour of Om Sai Tradders but sum of Rs.1,20,000/- has been withdrawn fraudulently and another cheque of Rs.21,500/- was given to one Sanjay Mishra, but sum of Rs.3,15,000/- was withdrawn from her account.
Learned counsel for the petitioner submits that informant had issued three cheques, as detailed in the F.I.R., and out of three cheques, two cheques were credited in the account of Om Sai Traders and amount of Rs.3,15,000/- was credited in the account of Amit Kumar. Further submission is that on the joint prayer of both parties, the matter was referred before the Mediation Centre, Patna High Court, where informant-opposite party no. 2 did not appear and due to that reason mediation could not be succeeded and petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-I, Kaimur at Bhabua, in connection with Ramgarh P.S. Case No.
Patna High Court CR. MISC. No.21083 of 2019(3) dt.05-08-2019 3/3 04 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
