JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2017 The petitioner is apprehending his arrest in connection with Ram Krishna Nagar P.S. Case No. 207 of 2016, registered for offences punishable under Sections 406 and 420 of the Indian Penal Code.
The allegation as per FIR against this petitioner is that he is owner and driver of the Tempo which has been engaged by the informant for supply of drugs and that he has taken drugs of Rs. 398984/- for supply it to the stockist at Govindmitra road but he has not delivered the same and he tried to grab the same and also switched off his mobile.
It has been submitted that no date has been mentioned as to when he has taken the drugs for supply and also, no bilty of the goods and other papers have been mentioned in the
Patna High Court Cr.Misc. No.16660 of 2017 (2) dt.11-04-2017 2/2 FIR and he has falsely been implicated in this case. Heard learned A.P.P. also.
Having heard both sides and in view of direct allegation against the petitioner, this is not a fit case for grant of anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail of the petitioner is rejected. Let the petitioner surrender before the court below and make prayer for regular bail which will be considered on its own merit without being prejudiced by this order. (Vinod Kumar Sinha, J) Ravi/- U T
