JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-10-2015 Heard learned counsel for the petitioner, the learned A.P.P. for the State and learned counsel for the informant. The petitioner apprehends his arrest in connection with Nayaram Nagar P.S. Case No. 115 of 2015 registered under Section 377 of the Indian Penal Code. The prosecution case is that on 20.07.2015, Chotu Kumar, son of the informant had gone for cutting the grass. In that course, he heard hulla and went there and saw his son Chotu Kumar was lying naked and Sudhir Das and Vinod Thakur were abusing and altercating each other. Thereafter, Sudhir Das made allegation against the petitioner about committing un-natural offence with son of the informant Chotu Kumar. Learned counsel appearing on behalf of the petitioner submits that petitioner is aged about 60 years. Due to installation of transformer, some hot talks were exchanged in between Sudhir
Patna High Court Cr.Misc. No.42678 of 2015 (2) dt.09-10-2015 2/2 Das and petitioner. Sudhir Das got managed to lodge this false case. It is also submitted that while the victim was examined but no any sign of un-natural offence or injury was found. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Munger, in connection with Nayaramnagar P.S. Case No. 115 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J.) Shail/- U T
