JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-10-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Complaint Case No.2615/12 registered under Sections 498A, 323/34 of I.P.C. and Section 3⁄4 of Dowry Prohibition Act. Learned counsel appearing on behalf of the petitioners submits that on the joint prayer of the learned counsel for the petitioner and O.P. No.2 the matter was referred to the Patna High Court Mediation Centre, Patna but mediation could not succeed. On the other hand, learned counsel for the O.P. No.2 submits that O.P.No.2 is not ready to live with the petitioner because petitioner has performed remarriage and he has admitted this fact before this Court.

Having considered the facts and the circumstances of the

Patna High Court Cr.Misc. No.10525 of 2017 (7) dt.06-10-2017 2/2 case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
