This application for grant of regular bail arises out of K.Nagar (Champanagar) P.S. Case No. 16 of 2020, disclosing offences punishable under Sections 379 and 411 of the Indian Penal Code.

The petitioner is in custody since 15.01.2020 and allegedly he was caught by the villagers when he and his accomplice were attempting to take away the informant's buffalo..

Learned counsel appearing on behalf of the petitioner has submitted that the petitioner has been unnecessarily roped, in the criminal case only because he was found passing through the place in question. Even the informant did not find the

Considering the circumstance that the petitioner was apprehended by private person on the allegation of attempt of committing theft of the informant's buffalo and that the petitioner has remained in custody since 15.01.2020, this application is allowed.

Let the petitioner above-named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in K.Nagar (Champanagar) P.S. Case No. 16 of 2020.
