2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 66, 66(c),66(D) of the I.T. Act.

3. Allegation against the petitioner is that he being an employee of ICICI bank along with other co-accused persons is said to have involved in siphoning money of the several account holders of the said bank and thereby committed fraud of total Rs. 20,28,223/-.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that similarly situated co-accused has already been granted bail by this Court vide order dated 10.04.2023 passed

Patna High Court CR. MISC. No.30773 of 2024(3) dt.26-07-2024 2/2 in Cr. Misc. No. 66706 of 2022. He submits that the petitioner is ready to return Rs. 6,26,000/- in the said Bank within six months in installments. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application.

5. Learned APP for the State and Economic Offence Unit oppose the prayer for bail.

Considering the facts and circumstances of the case, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on provisional bail for six months on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Economic Offence P.S. Case No. 05 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.

7. The provisional bail of the petitioner shall be confirmed by the learned court below after showing the receipt of deposit of Rs. 6,26,000/- in the concerned Bank. (Anjani Kumar Sharan, J) devendra/- U T
