====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 25-01-2021 Heard learned counsel for the petitioner and the State. In the present case, the petitioner is seeking bail in Bela P.S. Case No.252 of 2019 registered for offence punishable under Sections 394/34 of the Indian Penal Code. The allegation against the co-accused including the petitioner is to have looted Rs.8,61,854/- at the point of pistol, however, counsel for the petitioner submits that during investigation, the name of the petitioner has come and CCTV footage does not disclose the involvement of the petitioner. It is urged that the petitioner is in custody since 24.12.2019 and similarly situated co-accused Nitish Kumar has already been granted bail by a coordinate Bench of this Court vide order dated 23.12.2020 passed in Cr. Misc. No.23348 of 2020. Considering the facts and circumstances of the case,

No.22047 of 2020(3) dt.25-01-2021 2/2 the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Bela P.S. Case No.252 of 2019 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
