The petitioners apprehend their arrest in connection with Aurangabad Town P.S. Case No.261 of 2015 registered under Sections 147, 148, 341, 323, 307, 337, 338, 379 and 427 of the Indian Penal Code.
The prosecution case is that the on 20.06.2015, one patient, Dolly Devi, wife of the petitioner no.2, Mantu Singh,
Patna High Court Cr.Misc. No.42689 of 2015 (2) dt.12-10-2015 2/3 who was pregnant, was admitted for treatment in the clinic of the informant, Dr. Ashit Ranjan and seeing the condition of Dolly Devi, the informant referred her for better treatment to some other hospital and she was taken at 08.00 P.M. in the same night. Thereafter, all of sudden, on 23.06.2015, the mob 100-120 in numbers alongwith 9 persons named in the F.I.R., including the petitioners variously armed, came and started to pelting stone at the clinic of the informant and damaged the goods and clinic of the informant.
Learned counsel appearing on behalf of the petitioners submits that the petitioner no.2, who is the husband of Dolly Devi, who was admitted in the clinic of the informant, has also lodged a case against the informant, due to that reason, the informant has lodged this false case implicating the petitioners also.
Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within four weeks, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad (Town) P.S. Case No.261 of 2015,
