====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 16-08-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 14.09.2018 in a case for the offence registered under Sections 392 and 411 of the IPC.

The prosecution story, in brief, is that on 11.08.2018 at about 6.00 P.M., while the informant was going towards Kanauli from Bhutaha after loading goods on his Auto rickshaw, three boys riding on Motorcycle stopped his Auto rickshaw, assaulted him and took Rs. 8,000/- from his pocket and Mobile Phone. They also took Mobile Phone from Shiv Kumar Mirdha and fled away. The accused person who has taken the money from the informant, was apprehended by 4-5 persons through

Patna High Court CR. MISC. No.21602 of 2019(4) dt.16-08-2019 2/3 Motorcycles. He disclosed his name as Parmeshwar Yadav @ Petrol Yadav (petitioner) and name of other co-accused as Roshan Yadav. One person also informed that three persons riding on Motorcycle looted Silver Hansuli from the wife of Bhaji Mukhiya and her son Pramod Mukhiya after assaulting them. One boy named as Hajrat was apprehended and who disclosed the name of other accused as Roshan Yadav and Pandit Yadav. The police seized a Motorcycle and a Cellphone in presence of this petitioner and Md. Hajrat. It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner.

No stolen property is alleged to have been recovered from possession of the petitioner. He has remained in custody for more than ten months. On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.
