JUSTICE ASHUTOSH KUMAR ORAL ORDER 31-03-2022 Heard Mr. Sunil Kumar, the learned counsel for the petitioner and the learned APP for the State. This case has been up-listed for hearing on priority as it has been communicated to this Court that the father of the petitioner has died on 23.03.2022 and the petitioner is required to perform the Shradh ceremony.

The petitioner seeks bail in anticipation of his arrest in connection with Kathaiya P.S. Case No. 120 of

Patna High Court CR. MISC. No.34211 of 2021(2) dt.31-03-2022 2/3 2018, dated 16.05.2018, instituted for the offences under Sections 147, 148, 149, 447, 341, 342, 323, 307, 353, 386, 427, 431, 504 and 506 of the Indian Penal Code. The accusation in the F.I.R. is that when the police party tried to nab an inebriated person, many persons came in protest and resorted to vandalism. The petitioner though has been named in the F.I.R., but there is no specific accusation against him.

It has been urged on behalf of the petitioner that he has no connection whatsoever with the person who was arrested by the police and was put to breath-analyzer test. He has been named only on suspicion and, perhaps, on the prompting of the local people.

The petitioner is a teacher in a primary school which is situated in the locality where the occurrence is said to have taken place.

Regard being had to the facts afore-stated and taking into account the clean antecedents of the petitioner, he, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be

No.34211 of 2021(2) dt.31-03-2022 3/3 released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Muzaffarpur in connection with Kathaiya P.S. Case No. 120 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
