Petitioners seek regular bail in connection with Trial No. 5932 of 2021 arising out of Manjhgarh PS Case No. 306/2021 registered for the offence punishable under Section 414 of the IPC and Sections 30(a), 30(b), 30(c), 37(b) and 37 (c) of Bihar Prohibition & Excise Act 2018.

25 litres of illicit liquor along with some equipments used for manufacture of wine has been recovered from the house of the petitioners.

Learned counsel for the petitioners submits that no illicit liquor has been recovered from their conscious possession and they being ladies reside in their husbands' home who are own brothers and they were not aware about the illicit

He next submits that petitioners having no criminal antecedent are in custody since 08.11.2021, the charge-sheet has been submitted and there is no likelihood that the petitioners will abscond or tamper with the evidences, if they are granted bail.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioners having no criminal antecedents are in custody since 08.11.2021, the charge-sheet has been submitted and there is no likelihood that the petitioners will abscond or tamper with the evidences, if they are granted bail, I am inclined to grant regular bail to the petitioners.

Accordingly, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned ADJ-II-cum-Special Excise Court No. 1 , Gopalganj in connection with Trial No. 5932 of 2021 arising out of Manjhgarh PS Case No. 306/2021.
