JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-04-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with S.T. Excise No. 99 of 2019, arising out of Pipra P.S. Case No. 40 of 2019, for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 18.02.2019. He further submits that in the instant case total 250.50 litres of foreign liquor was recovered. He also submits that the recovery was made from the Mango garden of Sanjay Mandal and not from the possession of the petitioner. Considering the fact that the petitioner has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/-
