JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-07-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the opposite party no.2. The petitioner is apprehending his arrest in a case registered under Sections 366, 365 and 498 of the Indian Penal Code.

Complainant alleges that on 11.3.2016 when his daughter, aged about 17-18 years, did not return to the house from the school till 12 Noon, he suspected that this petitioner, who was in talking terms with her, might have taken away her . It has been submitted on behalf of the petitioner that the victim girl in her 164 Cr.P.C. statement has stated that she had left house at her own sweet will. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below it hin a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Kishanganj in Complaint Case No. C 825 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
