2. In this case, the petitioner is seeking regular bail in connection with POCSO Case No. 62 of 2024 arising out of Chautham P.S. Case No. 200 of 2024, G.R. No. 2099 of 2024 registered for the offences punishable under Sections 96, 3(5) of BNS.

3. According to the allegation, the informant's minor daughter became traceless. During course of search, she came to know that the accused persons, named in the FIR, had kidnapped her minor daughter.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The victim, in her statement under Section 183 of the BNSS, did not support the prosecution case. She stated that the

She herself boarded in the vehicle and she could not know where the petitioner brought her. It has further been submitted that the petitioner has remained under custody for near about one year.

5. On the other hand, the learned counsel for the informant has opposed the prayer for bail by submitting that the age of the victim at the time of occurrence was 14 years.

Considering the above-mentioned facts and circumstances, period of incarceration i.e. near about one year and also considering the clean antecedent, let the petitioner abovenamed be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VI th cum Special Judge POCSO, Khagaria in connection with POCSO Case No. 62 of 2024 arising out of Chautham P.S. Case No. 200 of 2024, G.R. No. 2099 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
