2. The petitioner seeks regular bail in connection with Dariyapur P.S. Case No. 457 of 2024 registered for the offence under Sections 103, 3(5) of the BNS, 2023.

3. As per the prosecution case, one Nitin Singh is said to have assaulted the victim with a sword and thereafter the petitioner is said to have assaulted the victim with a rod in the stomach of the victim.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 09.02.2025

5. Learned A.P.P. for the State has vehemently

6. From the post-mortem report, it appears that the deceased has sustained two injuries in his stomach which are stab wounds.

7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Saran at Chapra/concerned Court below in connection with Dariyapur P.S. Case No. 457 of 2024 subject to condition that:- (i) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioner.
