JUSTICE RAKESH KUMAR ORAL ORDER 04-10-2016 Heard Sri Ajay Thakur, learned counsel, who was assisted by Sri Nilesh Kumar, learned counsel for the petitioner and Sri Ram Sumiran Roy, learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 23.04.2016 in Phulwarisharif ( Janipur) P.S. Case No.237 of 2016 registered for the offence under Section 366(A)/34 of the Indian Penal Code, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. However, after going through the statement of the victim girl recorded under Section 164 of the Code of Criminal Procedure, it is evident that the victim girl is a minor and she has stated showing implication of the petitioner.
Patna High Court Cr.Misc. No.40628 of 2016 (2) dt.04-10-2016 2/2 In view of the fact and circumstances, there is no ground to extend the privilege of bail. The petition stands dismissed.
