This application for regular bail arises out of Harsidhi P.S. Case No. 353 of 2019, disclosing offences punishable under Sections 272, 273, 188, 420, 308/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner is in custody since 06.02.2020. From the F.I.R., it appears that huge quantity of illicit liquor (200 liters) and raw spirit (6200 liters) were recovered from a truck. Allegedly, the persons, who were occupying the truck, managed to flee away, taking advantage of the darkness. Some of the persons present near the place, where the truck was recovered, are said to have disclosed the names of this petitioner and some other persons, based on which, they have been named in the

Learned counsel for the petitioner has submitted that similar circumstanced Sheikh Ekram Mian has been allowed regular bail by this Court by an order dated 13.05.2020 passed in Cr. Misc. No. 18161 of 2020 and an order dated 13.01.2020, passed in Cr. Misc. No. 77059 of 2019.

Considering the above submission and manner in which the petitioner's name emerged, leading to his implication in the case, this application is allowed.

Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned 9th Addl. Sessions Judge-cum-Special Judge, Excise, Motihari, East Champaran, in connection with Hasrsidhi P.S. Case No. 353 of 2019.
