The petitioner apprehends his arrest in Sitamarhi Complaint Case No. 526 of 2013 instituted for the offence under Section(s) 406, 420, 467, 468, 471, 34 of the Indian Penal Code. It is alleged that petitioner and other accused persons approached the complainant to deposit the money under 'Central Bank Karamchari Swavlambi Co-operative Society Limited'. The complainant started depositing Rs. 500/- daily and deposited the said amount from 03.07.2009 till 29.05.2010. The complainant was also provided receipts against his deposit, but when the complainant and others went to the office for return of their money, the money was not returned. It is alleged that petitioner was Director of the company from the year 2001 to

It has been mentioned in the complaint petition itself that witness Nos. 1 to 12 has also deposited the money to the tune of Rs. 1, 20,79,828/-.
In such circumstances, since there is serious allegation against the petitioner of misappropriating the money of the complainant and other depositors, this Court is not inclined to enlarge the petitioner on anticipatory bail. The prayer of the petitioner for anticipatory bail is rejected. The petitioner is directed to surrender before the Court below within a period of six weeks from today in connection with Sitamarhi Complaint Case No. 526 of 2013, Trial No. 2173 of 2016, and seek regular bail, which shall be considered and disposed off, preferably on the same day, on its own merit without being prejudiced by the order of this Court.
